In October 2021, Finkelstein & Partners trial partners Kenneth Fromson and Andrew Finkelstein argued successfully in front of an Orange County jury that a company’s employee who drove distracted and hit the firm’s client in the rear caused serious bodily injury and should be held accountable for their actions. The jury’s verdict, totaling $13,500,000, was the second highest in the entire state that year. But there’s more to the story than the happy ending.
Over eight years earlier, the crash victim had to be rushed to an emergency room. Although no bones were broken, the impact had caused significant pain and injury to her ankle and shoulder, forcing her to undergo multiple surgeries. After accusing her of opportunism and lying, the defendant’s insurance company offered a settlement that was little more than an insult. Convinced of the merits of their case and the client, the Finkelstein and Partners team forged on to trial. Recognizing the defendant’s repeated attempts to discredit the victim, who had endured close to 10 years of severe physical and emotional pain, the jury ruled in her favor, sending a powerful message. Noted Atty. Finkelstein, “Our client truly suffered. We were relieved and grateful to the members of the jury for acknowledging the driver’s responsibility. This decision not only provided our client financial relief, but also enabled her to finally look to the future with hope.”
